My fiance said the bank said it was an Electronic Fund Transfer on the account. Do I believe this is from Homeland Security..or something else? He's at work right now so I can't really ask him about the entire conversation. This is what he told me last night: " It stated that the check has been pulled via EFT (Electronic Funds Transfer) from my account. No check number was used (IE: my check never cleared, it was eft'd)."

Either way..there's an inquiry on it..not sure if that will harm us or help us.

I'm pretty sure that the EFT had to be from Homeland Security.. but my fiance panicked, especially when he was told it wasn't there.

My only concern is .. We mailed the package around June 20th (A friday, and through regular mail -. - , guuh). The cheque was cleared around June 30th, according to my fiance when he checked his bank account. To this point, we haven't receieved a NOA1, and thus that is why I got worried and had him check his bank account again to see if it had been cleared, and to see if the bank could get him a copy for the EAC number, so we could have some sort of tracking number for this process. The fact that its been over a month, and not a few weeks is why I wasn't sure in the first place.

When he called, that's when they said it wasn;t there, and not knowing that Homeland security uses EFT, his 2+2 = someone stole the money and the application never made it. He's having an investigation on the cheque, so hopefully it just turns up that it was them that have the funds and we'll just keep waiting for the useless NOA1.. I just hope him freezing his bank account yesterday would give us a RFE and the money has already been paid.

I'll start there, hopefully the bank will be able to figure that out..you'd think they would know who's taking your money but who knows, haha. Since my fiance put in an inquiry and froze his bank..maybe they'll already working on seeing who did it. Hopefully we get this figured out..if not..guess I'll have to resend. It's not like I didn't know this process was full of long waits and frustrating turns of events when I signed up!

The only problem with that is he works Monday to Saturday, so I don;t think he could get an appointment ><

I think its odd that no one else has seen the EFT .. but its there on the instructions for the application.. and these instructions have the dates 07/30/07 on them. I am so confused now! Ahhh.

Should I just have him try and find out from the bank who did the EFT (that is, if they can).

Also, I'm pretty sure he would have called the 1-800 number.

When a cheque is cashed it's not an EFT. The USCIS does not use EFT.

When you give your employer your banking information and they deposit straight into your account thats an EFT. If you give your car insurance provider your banking information so they can withdraw your insurance payment monthly that is an EFT.

Your fiance definatly did the right thing freezing his account if he feels someone is wrongly making EFT's on his account.

Really? I'm really confused now, because on the instructions for the I-129f, it says

"Notice to Those Making Payment by Check. If you send us a check, it will be converted into an electronic funds transfer (EFT). This means we will copy your check and use the account information on it to electronically debit your account for the amount of the check. The debit from your account will usually take 24 hours, and will be shown on your regular account statement. You will not receive your original check back. We will destroy your original check, but we will keep a copy of it. If the EFT cannot be processed for technical reasons, you authorize us to process the copy in place of your original check. If the EFT cannot be completed because of insufficient funds, we may try to make the transfer up to two times."

He's blaming himself because I told him to send it through UPS or some other mail carrier with a tracking number, and he sent it regular mail :|

If it helps, we filed on April 4th and received our NOA2 on July 17th or something time that. According to other timelines that are similar to ours it looked like 3.5 months was about average.

Thanks so much both of you, you answered the questions just as I hoped you would. I got my long form Birth Certificate a few months ago and a new passport since mine would have expired early 2010. All I need to do is get a list of my current vaccinations and figure out what else I need to get, as well as get that criminal record check (which will be easier than I though!! YAY!... thanks for clearing that up!). I can't wait to get all this done!!

Hey everyone!!

My fiance and I got our NOA2 in the mail a couple weeks ago (YAY!!!) and now that we have celebrated getting passed that leg of the journey, we are starting to prepare for the next part. We got a letter in the mail (I can't remember exactly what it said and he has in there in the US) I think it said that within the week the US consulate in Vancouver BC would be sent our petition. Then I am assuming I should be getting my packet within a few weeks. So... now that we are getting ready for that, I am starting to wonder a bit about what to expect. So a few questions:

1. Can anyone tell me what their experience has been with AP. I had a friend immigrate to the US a few years ago and was told by her family that she wasn't allowed to leave the US for 2 years, though she ended up getting AP for a family emergency. However, I have been reading on here that you apply for it with your Change of status and usually get it within 60-90 days... does that sound accurate. I am from Canada and live only a short distance from my fiance's home, so I am hoping that I will be able to visit before "2 years".

2. How long has it taken others to get their work permit?? I am going to go crazy not working and I am looking forward to helping support my future family (and doing tons of reno's in our new house!!). Should I expect it within 60-90 days as well?? or could it be sooner or maybe take longer??

3. I have lived in 6 different cities since I was 16, am I required to get Criminal record checks in all of these places?? even if I was only a student (not technically a permanent resident?? (I listed the ones within 5 years on the biometrics... therefore probably need all, correct???)

4. When I move all my things to the US (assuming I get my visa) how do I go about doing this??? I haven't heard much about this, but as I will be moving from Canada, I plan on crossing the border by car.

Well, I have about a thousand more questions, but this is a start. Best of luck to all those others waiting to hear what direction their future will take. I thank God everyday that I met my fiance and I can't wait to spend the rest of my life with him. My thoughts and prayers are with everyone else waiting and praying for the same thing!!!

I'm not sure if this helps, but my fiance and I applied at the beginning of April for our I-129F and I went to visit him 3 times since then, and we got our N0A 2 in the mail in the minimum amount of time - just over 3 months (and I will add, they gave me some trouble at the border on one of those occasions). I don't know if this can tell you anything about you and your visa, but I would think that it would be good for you to spend as much time visiting as you can. They want to know that you have spent time together and showing that you would take the time and the money to travel to be with your fiancee seems like a good indicator that you have a real relationship. Though, this is just my take on things.

From one person in a long distance relationship to another, however, I hope you DO get to see her... I just returned from seeing my soon to be hubby today and it is already killing me!!

Hi Everybody! I've been browsing this forum for a couple weeks now, as my fiance and I are preparing to file at the end of this month. I've tried to scour the guides and threads for this information, but I wasn't able to find the answers I was looking for with regards to two areas:

1. My fiance is still in school until the end of this year, and as such when he fills out his G-325A it will be there that he is current unemployed. We've got the necessary sponsor for the affidavit of support when the interview time comes around, but will the unemployment be an issue at this early stage? Even though I know it will be requested later regardless, should we submit the affidavit of support with the initial package just in case?

2. With regards to the I-129 and declaring "Where your fiance intends to live", we would not have the specific address until further in this process once my interview is complete and we've gotten an apartment. (I don't really want to live with his present roommate... tongue.gif). That said, is it entirely necessary to have the specific address on the I-129? Or can that be changed later?

Thanks so much for your help! I was so terrified about this process and while we haven't filed yet, I already feel calmer having read so many stories and advice.

You must be a legal resident of the country for 6 months before you can file DCF. So you must follow the residency requirements for that country to get legal residency then 6 months after that you can file DCF.

I agree with YuandDan - she is likely to get the K-1 before an H1B.

If you want to work when you enter the US then the CR-1 is the way to go. Upon entry into the US you can work right away, not the case with the K-1.

So yes, you can get married and file the paperwork. Be sure not to overstay and return to Canada for processing and the interview in Montreal.

1. Passport size photos are supposed to be to American standards - 2x2 inches. I am not sure if they will accept Norwegian standards or not. I know they did not accept the Canadian standards which were slightly larger than the US ones.

2. Don't send originals to USCIS and makes at least 2 copies of the entire packet just in case. The originals will be submitted later.

3. Don't write a novel or include dialog but be specific enough to include dates and locations.

We sent the bio page of my husband's (the USC) passport and that was all, no copies of stamps and no blank pages. We got an RFE but not for that. You're fine if you simply submitted the bio page of his passport

^^ Agreed! The waiver so SO much more than a form or a simple letter. It is an entire packet containing doctor's letters, financial statements, etc. A qualified lawyer can help you organize a great argument and packet, going into that interview will give her much more confidence if she has an excellent packet.

Agreed that it can be done yourself and this is an excellent site for help, but so is immigrate2us.net. They are specialists!
