To my limited knowledge there is no problem with applying for two different visa's at the same time. I would think however that applying for the K-1 would make actually receiving her employment based visa very difficult.

I don't think theres anything illegal about applying for both.

If she does receive her employment visa you can have the K-1 going through the works at the same time and then she will need to return back to her home country for the K1 visa interview.

1. What is NOA1 ? I see it listed as "first notice" in the FAQs etc. but what exactly is it ? is form 797C a receipt with number considered an NOA1 ? Or is it just the 797C and I am yet to receive NOA1 ? I am unclear.

2. What exactly is NOA2 ? It says on the FAQs , guides etc., that it is 2nd Action of Notice for me and my fiance to start gathering required documents such as proof of relationship, identity, citizenship, passport photos etc.
But I already submitted all those things along with much extra material along with our G325A and I-129 forms. So will I still receive NOA2, since everything is already submitted ?

Yes you will receive an NOA2, you need the NOA2 for your interview at the consulate which is where they will actually give you a visa.

3. My fiance has a daughter. Her daughter will not be initially coming to live with us, she currently lives with her father. But she will most likely be coming to USA once she reaches high-school age, in about 2-3 years.
What kind of visa is used for a foreign child of a US citizen or legal resident ? I looked around and on the USCIS website and I am confused. is it K1, or K2 ? and which forms ? I-129 ? or I-130 ? also what are the timelines and
procedures on such ? is it the same as the K1 fiance visa ? about 5 months ? longer ? shorter ? I do not see info on K2 visas available.

As long as you included the daughter on the I-129f under children of beneficiary then you are golden here. You will be able to include her later when your fiance does her portion of the application.

4. What sort of visa do we need for her daughter just to come for a summer vacation and then go back to China ? I do not see any info on this whatsoever.

That would be a B2, however it might be in your best intrest to have her use her K2 visa at that time and then you can proceed to do her AOS even after she returns home. Don't quote me on that I could be wrong.

You can send the I-129f whenever you want the when is not nearly important as the how. Make sure you read through the guides and make sure you have all the required documents and other stuff.

You'll see more people filling in timelines everyday, the list will continue to grow. There are some slower months however for whatever reason. March vs. April was fairly significant last time I checked. I think also that the summers are a bit slower as people are spending time on vacations together and wait until vacation time is over to file.

Take a look in the embassy section and see what your specific consulate requires from you. The I-134 is optional at my consulate at this stage. She will receive a package with more information, the one thing she will need for sure is the NOA2.

I wouldn't count on being able to do this. Better safe than sorry it would suck to plan on a short trip and not be prepared for having your K1 used up.

So long as you are a citizen of Canada the Canadian Border will never be closed to you. The American one is the one you might have trouble getting through. Bring a return flight and your NOA1. Tell the truth and check out the guides, theres a section dedicated to Canadians visiting Americans during the process.

No judgement :

There will be red flags if you apply again for anyone. Within the next 2 years will be even more red flags due to having to get a waiver. The onus of proof will be on you to prove that any future relationship is bona fide.

What you write on your letter doesn't really matter as long as you make it clear that you are "Withdrawing your I-129f". Be sure to include the case number and keep a copy for yourself handy. In a couple of weeks call the USCIS to verify that they received your withdrawal.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

The above conditions are serious and can result in the separation of families for many years if not taken seriously.

I don't recall there having been a spot for adress in native alphabet only their name in the native alphabet. If there is a spot for adress in native alphabet I would do as you are suggesting (translate the adress).

However if there isn't I would not. Any records that the immigration people might be trying to get off of an adress would not be searchable by their english spelling, I would think.

If you are concerned you can always attach it on a seperate sheet and let the adjuticator decide which on to use.

Do not tamper with or change in any way your "certified copy" of any of your divorce decree's. At that point they are no longer considered "certified".

The USCIS does not care about the sorted details of your personal life, they might however wonder what you're hiding if they notice black streaks all over your official documents.

Christmas I think is realistic for Montreal but definatly much sooner for Vancouver.

Congratulations!! You can call the NVC @ 16033340700 to find out when your case gets forwarded to the consulate. At that point you can call the DoS @ 12026631225 to find out whne the consulate has shipped you packet 3.

I'd be reluctant to call this early, boy who cried wolf mentality, you may need them to take you seriously at some point. If it's not been 5 months than generally they won't take you seriously. I've heard of people scheduling info-pass appointments and making a service request a bit earlier that the time frame. (The case I'm thinking of was at 5 months back when the time frame was 6). That has been occasionally successful.

Agreed, no one can guess if you will or won't get an RFE but it won't hurt to have a few passport pictures already in your possesion in case you do.

Really? I'm really confused now, because on the instructions for the I-129f, it says

"Notice to Those Making Payment by Check. If you send us a check, it will be converted into an electronic funds transfer (EFT). This means we will copy your check and use the account information on it to electronically debit your account for the amount of the check. The debit from your account will usually take 24 hours, and will be shown on your regular account statement. You will not receive your original check back. We will destroy your original check, but we will keep a copy of it. If the EFT cannot be processed for technical reasons, you authorize us to process the copy in place of your original check. If the EFT cannot be completed because of insufficient funds, we may try to make the transfer up to two times."

He's blaming himself because I told him to send it through UPS or some other mail carrier with a tracking number, and he sent it regular mail :|


I've never seen that before. Most people have a picture of the cancelled cheque available to them at their bank.

As you can tell, there's a few problems with this whole thing.

He told me that he could not view the cheque online when I asked. He uses Bank of America, so I don't know if that makes a difference or not. When I keep prodding him about numbers on the cheque, he told me that the check was never endorsed and it was a straight EFT for the amount written on the cheque. He had an inquiry put on who made the EFT, but other than that, there isn't anything we can do. I am going to try and convince him to call the bank again and see if there's anything at all. As I said before, I am not even sure how an EFT works, and the fact that USCIS says they use EFTs but no one here can really agree if they do or not, the whole thing is utterly confusing.

As for the mail.. he has two addresses; his legal address isn't the same one he comes home to everyday. He checks his legal address once a week or so, and I told him that we should have gotten one. However, this isn't the first time the government has done this to him.. we had the same wait problem with his passport, where they said it was sent and it never showed up, and he had to get another one re-issued.

The other thing I wanted to ask.. if the bank says that it was Homeland Security that EFT'd the cheque..but they don't have a copy of that cheque for whatever reason, even though I am sure they must have something, how would we proceed to find out about our case if we don't even have a number to track by? Arrg. I am just hoping the Bank can tell us something but this whole thing has turned into a nightmare.

My fiance said the bank said it was an Electronic Fund Transfer on the account. Do I believe this is from Homeland Security..or something else? He's at work right now so I can't really ask him about the entire conversation. This is what he told me last night: " It stated that the check has been pulled via EFT (Electronic Funds Transfer) from my account. No check number was used (IE: my check never cleared, it was eft'd)."

Either way..there's an inquiry on it..not sure if that will harm us or help us.
