Are we talking cavities? To the best of my knowledge that is not a concern for immigration. If their bothering you however and care is available than you should get them done.

No fee's would be waived, you'd have to cancel your original petition and then refile the i-129 and the i-130. You'd probablly get more specific answers in the CR-1/K3 forums.

firdaus, when your case was pulled for AP, although they didn't tell you it was under AP, they did tell you they got the case, right?


My case jsut got to the NVC on the 30th. When I phoned on Friday I was told that I was in additional processing, I believe that all cases are considered in AP during their stay at the NVC. I'd call again on Monday.

That depends on you partly. Your case will get forwarded to the NVC form there to your consulate. Once it's at the consulate and you receive and return packet 3 you can call the DoS and find out when your interview has been scheduled for. I would say between 4-6 weeks provided you return the packet 3 promptly and arn't held up at the NVC.

I would like to know, if there is a way to reach the California Service Center USCIS and actually talk to someone live about this, I need peace of mind, or find out whats going on and straighten it out if there are any problems.

6 weeks is not a long time to be waiting you have several more weeks of waiting to go. The USCIS website says you can expect to wait 5 months.

As the above poster said you can follow the prompts to change your adress or follow the prompts for the rfe. You arn't likely to get anywhere however because you are not outside normal processing times.

Have you opened an account at the USCIS website, that is going to give you just as much information as calling them on the phone.

I don't think you can file an I-130 for a son. I-130 is for a fiance/spouse already living in the US.

she moved but had the address forwarded to the new place so that all mail sent to the old place would be sent to the new house, then last week she changed the address online to the new address.Today she got the notice in the mail of change of address.

Mail forwarding can really slow things down. Did you say that she just set it up to forward last week? As in there was a lapse in the time between time that she moved and the time that she got her mail forwarded. It's possible that it is either sitting in the mailbox at her old adress or has been marked return to sender by the new mailbox owner, or they might even have thrown it out. Might be an idea to contact the person living at her old adress and ask if they've received any mail for her. If I'm understanding correctly that there was a period of time when she did not have her mail forwarded and did not have access to the box.

Regardless of what happens if she gets a new K1 in the future this will pop up as a red flag and she will be expected to answer questions about it. She doesn't technically need to do anything, when her visa expires it will become null and void and that will be that.

She could notify the consulate, but I'm not sure if she'd be in any better position if it were revoked. Maybe someone in the thailand thread will know a bit better.

To my understanding there are a lot of things can be forgiven when applying for a K1. Working illegally (although usually accompinied by living illegally) has been forgiven before.

This could become an issue at any stage, if the Adjuticator noticed it at the service center your problems could start there, otherwise it would most likely become an issue at the consulate.

Best of luck to both of you, this might be one of those cases that calls for a good immigration attorney.

If your parents home in Kentucky is where you would normally live then theres nothing wrong with listing that as your permanent residence. You might include on a seperate page that you are currently at 'such and such' and will be returning to your place of permanent residence 'kentucky adress'. That way you've covered all your bases.

The OP used the term 'under the table'. People who are self-employed and intend on paying taxes do not use this term. Your also speculating that this person has only been employed "under the table" for this tax year.

It is required by law to report tips as taxable income. I wouldn't advise an individual who is not reporting their tips to include that in there income when filling out the I-134, either.

It generally takes 6-8 months for a fiance visa so I think January would be out of the question. She could apply for a student visa but then when it was over she would have to go back to Brazil to start the K-1 process. CR1/IR1 is generally considered preferable to the K3 if you decide to go that route.

Someone posted recently a USCIS memo that stated that the G325A did not have to be signed by the benficiary for the USCIS stage of the visa. However expecting all USCIS employees to care about that memo is a whole other can of worms altogether.

second of all: I just looked out my local office(saint paul) & service center(nebraska). Just to clarify, I use my St. Paul location for interview needs, but as far as sending my I129F package I would send that to Nebraska? Are any of the service centers faster than others? haha JUST WONDERING!


If you are filing a K1 then for interview purposes you would use her local office. Not yours. You have to submit to either the Vermont or California Service Center depending on where you live. I'm thinking Minnesota goes to Vermont but I've been wrong before.

To my limited knowledge there is no problem with applying for two different visa's at the same time. I would think however that applying for the K-1 would make actually receiving her employment based visa very difficult.

I don't think theres anything illegal about applying for both.

If she does receive her employment visa you can have the K-1 going through the works at the same time and then she will need to return back to her home country for the K1 visa interview.
