Haha.. well.. I should mentioned that he called the bank up right after USCIS said there was nor ecord of the application being there and told them to freeze the account, and now there's an inquiry on the security. I don't know the WHOLE story, because he gushed this all in an email, exclaiming how pissed off he was and he needs to go calm down.

I just wanted to get some ideas on how to proceed. Part of me doesn't think the funds are stolen. I'll try and see if he'll call the bank again tomorrow, but he was pretty upset about it taking up most of his work time today (calling the bank twice and USCIS) that he might not even have enough time to do it.

It's just frustrating, especially because I wanted him to just see if he could get the EAC number from the cheque and I would call USCIS. But alas.. he went ahead and assumed the funds were stolen instead of trying to see if there was a number on the cheque instead of the cheque number..something I explained last night. Siiiigh, c'est la vie.

We sent the application in at the end of June, and on my boyfriend's bank account, the money was withdrawn. After not receiving a NOA1, I urged him to see if he could call up the bank and see if they had a copy of the cheque to get the case number, so he could call USCIS and find out if everything is okay.

When he called the bank, they told him that the cheque was pulled via EFT, as I know USCIS does. However, when he called USCIS, they said they had not received the petition.

Now he's upset and feels that someone has stolen the funds, and wants to resend the application. I'm just..not sure about it though. I guess its because I honestly don't understand EFT and it doesnt make sense to me that anybody off the street can make an EFT. Can anyone make an EFT? I dunno, anyways.

So my question is: do I try and get him to call his bank and see if they actually see a number on it (he was confused and thought he was looking for a cleared cheque and the cheque number, not a case number even though I did explain it to him)? Or do we just resend the whole thing because whoever he talked to at homeland security said they actually hadn't receieved the application?


Luckily he made copies and scans of everything, including the passport photos.. but I just have a couple of questions. Because the biography information is a scan, will they accept that as an original or do I need to resend them? He says he can print out my passport picture in photo quality - will they accept that as long as it meets the size?

Edit: I just wanted to add, when he called, he wouldn't have had the case number, so I wonder how they could even track if the application was ther eor not.. Does anyone know if they can track by names/addresses too if there's no number? Thanks.

Im filling out the DS-160 and it asks for my Passport Number, which I know what that number is but then it asks for the Passport Book Number (or Control number as it is sometimes called) Now there are two other numbers that could possibly be the "control" number: One on "page 3" with a barcode underneath it and the other is under my photo and stuff is another series of numbers... so which one is it?

yea bring all the recent proof that you can like recent pay stubs and highlight amounts showing his pay also get a letter from his employer stating like the other person said, his current income and that his job is steady and he is staying at it and all that. and just keep your fingers crossed that they go by his now income rather than his old income. my fiance's w2s and tax forms are not above poverty line and im worryed about that but he does get payed more then poverty line now so i know the worry that you are feeling right now, just find all the recent job and pay information you can and bring it with you to the interview, when they ask you be really confidant in the way you speak about his job and that he is doing well and has been making the required amount of money recently.

I used all print outs and had no problem at all, but i also photocopy any stamps and all stamps in my passport of visitng him and going on vacation with him, as well as all photos of him and I and his family that i had as proof.
I dont think really where you met matters as long as you have proof you met? I may be wrong tho but it would seem silly to be THAT picky about it lol.

If he submits the first round of papers within the next week or so, is it logical to say that we can marry in the early part of the new year? it'll be a small wedding within days of me getting over the border with the visa.

Yes, you can certainly file the I-129F while you are still in the US.

As Bobby_Umit says, you're looking at about 6 months. Montreal is ridiculously slow at scheduling interviews (generally 3 months or so) however, vancouver is slightly quicker. Where do you live?

The processing times posted on the USCIS website are an approximation of when they are adjudicating petitions. Some get approved before than, some are still waiting from 2008. Use it only as a rough estimate, not a hard and fast rule.

No, she can not live with you in the US while the process is being completed. She may visit you but she must return in the allotted time given to her to visit. Please do not intertwine "visit" with "live"

As long as she is truthful and can show strong ties to Canada, there is no reason why should would be denied for a 10 day trip. Strong ties include a lease or mortagage, utility bills in her name, bank statement in Canadian funds, even a doctor's apt. card (showing she has every intention of continuing her life in Canada). Plus an NOA-1 and 2 would be beneficial as well.

They don't. USCIS notifies you when they have received your case, when it is approved/denied, or if they require any additional information. They don't notify you when they actually pick it up to look at it.

We hired a lawyer for our Cr-1. They cannot speed up the process or ensure approval.

They CAN slow up your petition however.

What can help you get approved is having an organized petition with all the necessary documentation. Coming from someone who had a lawyer, you don't NEED one unless you have a complicated case. If you DO have a complicated case, they can be wonderful. If your case is straight forward, then you don't need one

I can't help you with all your questions but here are ones I can help you with. Being a Canadian citizen does absolutly nothing for your petition.

You can request a change in embassy but I am not sure how that works or even if it is possible.

NO - since you filed a K-1 you clearly have immigrant intent. Entering as a visitor with the intent to marry and adjust status is visa fraud. This can result in a lifetime ban. So no, it is not easier. You are doing the easiest route. It just takes time.

The best advice I have for you, is to wait it out in NZ. You filed in April so your NOA-2 should be coming soon. With any luck your interview will be before Christmas.

Your NOA-1 simply means they have received your petition and cahsed your cheque, no approval yet and not sure what priority date you are looking for.

We waited 4 months to get our RFE, there is no way to tell when/if you will get an RFE until your case has been reviewed by an adjudicator and that depends on the work load of the service center your petition is at.

No, your cheque number is not your receipt number. The receipt number will either start with EAC (indicating your petition was sent to Vermont) or WAC (indicating it is in California for processing). Typically the receipt number is on the back of the cheque however, I've read it can be listed anywhere.

Yes, you can visit.
It's actually a really good idea to. From what I've read at the interview they look for evidence that you have an ongoing relationship during the process.

If your fiance can, get him/her to send you a copy of the NOA1 or the actual NOA1 itself. I think it'd be helpful at the border because it proves you have to stay single for the visa and that you won't marry and adjust status to stay in the US.

Other people have suggested a copy of an apartment lease or a letter from your employer to state you still have a job to come back to.

I wasn't saying that he didn't need pictures at all. I was simply stating that at the USCIS, as outlined in their manual, pictures being secondary evidence are not required. My suggestion was that rather than waiting until he had pictures to file he should file now with compelling primary evidence and then plan to have pictures for later stages of the process.

Now obviously you've been on this site longer than I have and had an oppurtunity to perhaps know people that were in a pickle due to not having pictures. All I can go on is the RFE sticky. None of the RFE's in there specifically requested additional pictures, as a matter of fact the majority of the posts where from people who had sent lots of pictures and were requested to send 'additional evidence' and their solution was to send more pictures. Not many people apply without pictures this is true but I've yet to read one post form a person who didn't send pictures and was denied or RFE'd with the request for 'pictures'.

The only information that we can have to go on is what the USCIS tells us and the personal experience of the people on here. So if the USCIS says that photographs are secondary evidence than I'm inclined to believe them as it would not benefit them in any way to lie to us. If the people of VJ who did not submit pictures are not having an issue getting their NOA2's then I'm inclined to believe that as well. I see no flaw in my logic.

Once it makes it to the consulate stage it may be more prudent to have photographs, but the when and why of photographs is much less important at that particular point. From my readings I can tell you that the interviewers in Manilla (for the K-1) do not ask for pictures from this specific trip or that specific trip, everything I've read points to them asking for pictures in general.

Pictures are secondary evidence. Secondary evidence is only needed to suppliment weak primary evidence. I would not wait to submit your packet because you don't have any pictures. On the long shot that you do get an RFE, make it your intention to take a trip to the phillipines sometime between now and your expected adjutication date. That way even if you do get an RFE you're going to waste less time than if you put the whole thing on the shelf and waited to submit until you had picture.
