Hi guys, I hope yall are doing great ! I was wondering if someone could tell me what happens after we get NOA-2. I know that USCIS forwards the case to NVC. However, how can I know when NVC receives my case and forwards it to the consulate?
Also, if we are using a co-sponsor (my fiancees dad in this case), do we need to fill out 2 I-134's that is one from my fiancee and one from her dad or only her dad can sponsor me.

Maybe your understanding is different. Initial review is when USCIS receives your petition and gives it an initial check to see if there are any obvious disqualifying factors, such as you didn't sign the forms or didn't enclose a check for payment. If that happens they reject the whole thing and send it back to you. If they cash your check, you got past that. Then the petition gets in line with 35,000 or so others (per year) and gets adjudicated. Yes they do a background check at that time. Once approved it gets sent to NVC that also does a background check and then it gets sent to the consulate. It can be delayed for "additional processing" at any point in the process.

NVC will forward your case to the UK embassy/consulate. They will send you Packet 3. Includes a checklist with documents you will need at the interview and some forms to fill out. After returning the checklist/forms you will get Packet 4 with an interview appointment.

NOA-1 is the Notice of application-1 which the USCIS mails to you after they have received your I-129F file and the relevant papers. Upon receiving NOA-1 you will be given a USCIS case #. After they approve your I-129F, you will be receiving NOA-2, that is Notice of Action-2. This notice will tell your that you case has been processed and approved and sent to NVC (if they are convinced with the evidence provided).

You don't have to appeal a denial. (I could be wrong but I'm pretty sure.) IF your petition is denied you can accept the denial and go about refiling.

Even if you apply to have it withdrawn right now it can sit there. Theres no hard and fast rule with these things.

As you've mentioned you will need a waiver to reapply. I don't think it will do you any harm to attend the interview with the Annulment Decree and explain why it wasn't included initially. At the very worst your petition will be denied and you will have to refile anyways. It might even be faster than trying to cancel your current petition and starting over. That alone will raise more flags than forgetting or not understanding you need to include your previous Annulment.

That being said since your petition is at the consulate I assume, your fiance could send a notarized letter to them explaining your intent to refile at which point I'm sure they would say much the same thing that I have, perhaps less wordy. Or you could send a notarized letter to the consulate explaining your wish to refile.

The important part to the best of my understanding is that it be notarized and clearly state your "intent to withdraw".

You can probablly take the Anullment decree to the consulate. If the USCIS didn't care that you missed it the first time then you will be fine to just take it with you to the interview. No point throwing the baby out with the bath water as they say...

You'll probablly get more informed answers in the Japan thread (might be called asia thread). Your next step is to be patient as you wait for your NOA2. There is some stuff you can do such as research the packet 3 for your consualte and see what they expect you to have (ie. police certificates, birth certificates and such).

I think you can relax, when you filled out the forms there was no reason to check yes and being arrested doesn't mean much to the Embassy as long as you weren't charged and/or convicted and have the data to back it up.

Definatly apply now for a new criminal records check so that you can use it for your AOS and GC removal of conditions. Also like the above poster mentioned if you could get the police to give you a paper stating you were not charged and/or convicted. You could also ask them to include that you have never been found guilty of drinking the blood of innocent children, being a pimp or a #######, that however might be gratutious

1) K1 Visa - This is the fastest option. You can travel to the US and visit while you are waiting for the processing to complete.

2) This option is considered immigration fraud. Visiting the US with the intent to marry and adjust status is illegal.

3) CR1 would be the route that you would want to take here (K3 takes much longer and doesn't have as many benefits as the CR1).

1. You do not need to submit it in a folder. You should submit it with a cover letter which orders the document's behind it but definatly not tabulated. They will put it in the order and into a file when it gets there, just focus on including all the required documents.

2. Color is not required, you should include all pages that have a stamp on them.

3. Depends on what edition you are using, if it's the 4 page edition send it, if it's the new version you only need one copy.

4. You don't get to pick and choose the service center, if you are to file with Vermont than that is where you file. Sometimes Vermont and California will shift their overflow to another service center to help keep them even but you personally cannot make that request.

That's very interesting that they are calling it MMR and then telling you its administered in 3 seperate doses. I'd be a bit leary of the clinic you are going through. I've never heard of MMR causing an inability to get pregnant, I got one 3 weeks ago (my second shot in Canada they make you get it once as a child and once as an adult) and the nurse didn't mention anything about not being able to conceive for 6 months, but then I didn't ask either.

The gardasil comes in 3 shots I wonder if your fiancee didn't get confused about what vaccine was give over what period of time or something. I don't know but best of luck to both of you!!

The average wait time at the USCIS for I360 is 8.4 months right now, you should expect word any day now. You say you havn't heard anything but did you receive an NOA1? If not then I would definiatly suggest following up with another phone call.
