Your citizenship was acquired through birth? Then check that box - obviously you won't have a certificate number, that is for citizenship acquired through naturalization

If you can't fit it into the box (her place of birth) print of the document and write the state/country in the box so it fits (use black pen)

NEVER leave any questions blank. Use N/A or none where appropriate. If she is not in the US, but N/A

I honestly think USCIS is WAY too busy to be placing calls to beneficiaries. Put whatever number she is current at, I'm sure it will be fine

As for the signature, if she was born in Iran, I guess you'd have her write her name in Farsi (just assuming here) - but all her other info would be in English

Well, if you marry her then you won't be eligible for a K-1. You would need to cancel that, forfeit the fee and apply for a spousal visa (either a K-3 or a Cr-1). You would have to formally withdraw your application fee.

No waiting necessary - you can file as soon as you are married and the K-1 is cancelled. Just make proper notations on the forms.

Your estimate of May is liberal. Montreal is currently taking about 3 months to schedule an interview. Look at closer to 8 - 10 months to be on the safe side.

If you file the Cr-1, all you really need is your marriage certificate, and some primary evidence is always helpful (passport stamps, boarding passes). Secondary evidence such as pictures, e-mails etc also help.

1) I don't think so, it's not like you did anything wrong to no longer qualify for the visa, you simply aged out.

2) k-3 is slow, expensive, and obsolete. Read the guides to find out why Cr-1 is better (FYI - immediate green card is a definite plus)

3) Nope - all depends on your circumstances. Each case is adjudicated on a case by case basis.

4) You're confused. Your petition will go through USCIS first (generally 4- 6 months to approval) then to NVC and then on to the embassy (Montreal generally taking 2-3 months to schedule an interview after the petition is sent from NVC). Montreal doesn't do the whole thing.

5) You should read the guides to figure out which one is best for you. I like the saftey of the Cr-1 - immediate green card, immediate work and travel. The K-1 will save you a few months since you can file now without getting married.

no one can answer which is best for you, you need to figure that out on your own by reading the guides and finding what is most important to you.

1) Yes - there is a lot of paperwork with the fiance visa, but there is a lot of paperwork with any and all visas you apply for

2) Yes -that is how the spousal visa works, you marry and go back to Canada to wait.

3) No - that is an abuse of a tourist visa and is visa fraud. This can result in deportation and a ban from the US.

Quickest? The K-1 as you can apply NOW. But you do have to marry in the US (no one said you can't have another ceremony in Canada). The superior visa is the Cr-1 for spouses as it is cheaper and has many more benefits.

Most business signature always say use black ink, something about in the past it could be photocopies better. Blue ink had a tendency to not show up. I always see people saying sign in blue and I think where did that ever come from.

It depends where you live.
Western side of Canada gets Vancouver, Eastern gets Montreal.

And looking at your "From" thing, yours will be going to Vancouver.

Calgary does not process K-1s. Only Vancouver or Montreal.

2 extra weeks isn't much at all.
There are some things you just can't do until you know for a fact you got the visa and are able to move.

As much as I'd like to move right after I get my visa, I know I need to step back and tie up some loose ends, and I'm on the same continent as the USA.

Just give him a bit more time, I'm sure there's some things he needs to do now that he knows he has the visa. He's moving to be with you, it's a huge change, and sometimes reality doesn't strike the people who are moving until they really know they got approved.

K-1 visas are "single entry" visas.
You can file for Advanced Parole at the same time as Adjustment of Status though.
It allows you to come back into the country if you need to leave.

It's form I-131 if you want to look at it.
"This form is used to apply for a Travel Document, reentry permit, refugee travel document or advance parole. (if you want to leave the country before you are granted permanent residency)"

But once you get your green card you can travel again.

Interesting... two questions:
  1. What was your RFE for, if you don't mind sharing?
  2. If you didn't send letters of intent, how did you meet the requirement in 5.B of the I-129F instructions:
    "Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent"?




My RFE was for a missed box that didn't get checked off in the I-129F. Silly missed thing.
And good question about the 5.B thing.
Someone filled out the paperwork for us and didn't even tell us what we needed. She was going to do my G-325A based off of nothing. I told my fiance we needed to do them, and she ended up not asking for them and made me get things they didn't even need right away.
For all I know, the person who did the paperwork for us may have gotten him to do something like it, or she found evidence for it.
I wouldn't know. She didn't give us an exact copy of the petition. Real smart. sad.gif

So I actually wonder myself how I got approved without those letters. I will be bringing them to the interview, though.

Sometimes they don't get sent out accidentally.
It could also be stuck somewhere in the local post office, or maybe the address you gave them was wrong by even a number.

You should get your NOA1 before you check is cashed.
I've noticed most people do, that way you know they have your package.

After you get your NOA1, you should sign up for e-mail notifications.
You can do so here:

Now, not everyone will get email notifications or no date change on the website.
Most people do though.

And a "touch" is basically when someone picks up the package and moves it or does something with it.
Here's an example from my timeline:

I was touched May 18th. That was 3 days after my NOA1 date and 2 days before the check was cashed. My guess to it was that they went to the package and took the check out.

Touches can mean just about anything, but they're a good indication to letting you know they still have your case and it wasn't put in a wrong pile.

From what I noticed, they cash checks in waves.
I don't think they cash them every day. I think every few days or so, so it depends when your package gets there.
I'd maybe say 10 days tops.

And then after you get the NOA1 and your check is cashed, you wait for the NOA2. It's pretty much a waiting game inbetween.
NOA = Notice of Action.

A waiver may be needed though if you do it within 2 years of the last one, I think I read once.

Just had a couple more questions...

1) In a fiance visa they require that we have met personally within the last 2 years- I fulfill that requirement as in this year alone we have met 5 times...so is that good enough for them? we have pictures and passport stamps to prove that.

- My fiance and I met 6 times in the past 2 years. It's definatly good enough. Just make sure you include stuff to show ALL of those trips. More trips is better than less. At least that's my opinion.


2) If we go for the spousal visa route, what's the best option then-to marry in CANADA and he can go back and apply for the spousal visa? OR its best to marry in the US and then I fly back out to Canada and wait?

- I don't think it matters where you marry. Not totally sure about that one though, better ask someone who did that one.

3) I have been reading up online and they say that fiance visa takes approximately 6 months and the spousal visa take up to a year...but does the same wait time apply if your a Canadian citizen? is it any quicker if you have a Canadian citizenship?

- NO. Being a Canadian does not make it faster. In fact, Montreal is one of the slowest consulates I've seen when it comes to interviews. Which sucks.

The Consulate decides. We have no say.
And yes, right now it's taking 3+ months to get an interview. As for waiting to send Packet 3, I am not sure, but I'd have a look at your NOA2 expiry as a guide. I have heard that they will extend it automatically, but I wouldn't push my luck. lol Most people try to send it right away.
You can visit after sending packet 3, but as with any other visit, make sure you have sufficient ties to Canada (mortgage, lease, letter from employer, return ticket, etc).

You need two I-134s one from each and her fathers must include prrof he is a citizen or Legal Permanent Resident.

NVC will send a letter to your fiancee when they have forwarded the petition to the consulate. By the time you receive the NOA2 it would be advisable to have all other documents, forms, translations, etc. needed for the interview. The I-134s should be done as close to the interview time as possible
