If they asked you for the letter from your bank in the instructions you received, I'd bring it. The last thing you need is to be sent away at the interview because the CO requires more information from you.

Imaisha is correct. You can try and bring STRONG ties to the UK such as a letter of employment stating the expected return date, a lease on an apartment or mortgage for a house, utility bills, etc.

You can bring all the ties in the world showing you intend to return, however, the CBP may also see you are spending too much time in the US and deny you entry. No one here can say yes or no to the strength of your case. I've seen people on here with EXTREMELY strong ties get denied, but then I've seen people with no ties be admitted.

From someone who was denied entry twice, even with considerable ties to Canada, it can, and does, happen

I'm confused, if you are both in the US now then why not get married and file for adjustment of status? This will prevent separation, a return to your home country for the interview, and it is easier in the long run.

As for your evidence, I'd avoid the credt cards and the receipts (unnecessary if you ask me). Focus on primary evidence then do things like pictures, e-mails, letters from relatives (or your pastor)

I doubt a denial is in your immediate future, she sounds like she is prepared. Just answer honestly and be confident.

IF she is denied, there is nothing that can be done after the denial has been issued. She will be put on the next plane back to Sweden at her own cost. You doing anything after the denial could make things worse actually. But I doubt this will happen, I just wanted to answer your questions.

To me, it sounds like he was denied entry. If it was me, I'd take ANY opportunity at the interview to point it out. It is understandable that you forgot such a minor incident 8 years ago, what is not understandable is tyring to cover up your mistake. They know he was denied entry (I was denied entry and at my interview they knew the date, what I said when I was there, who I was with, documentation I brought with me - they knew it all)

Just point out the error and you will be ok.

Yes he can keep his American citizenship. He will be granted residency, not citizenship, if y'all decide to move to Canada.

No you don't have to be married, you can apply as a fiance for either Canada or the US.

As long as your fiance makes 125% above the poverty line (as shown on his taxes) then his self employment is a non issue, if he does not make that amount, y'all will need a cosponsor

^^ Agree, you should get married and your fiance (then husband) should file the petition for a Cr-1 visa at the US embassy closest to you. It is quicker and you'll be able to move back to the US together.

Cards are also good.

I'd start sending e-mails and start accumulating a phone log, You'll have to show an ongoing relationship once you file.

This is an expensive process, You'll have to show you have an income and can support your fiance when she arrives. If you are not in this positiong right now, that should be your first priority - getting a job to support your wife and your new life.

USCIS (it hasn't been INS in many years) will know about the asylum case so listing US addresses on your petition is no issue, in fact, USCIS will likely expect it. Having a SSN and A# again is expected if you applied for asylum and lived there for 16 years, expect USCIS to know everything, because they already do, so list everything truthfully it will be ok.

As for the I-212 this is likely since it seems like you were removed from the US. This will be filed at the interview for your K-1 visa (perhaps after but certainly not before - have it ready to submit at the interview incase they accept it). The I-601 will be for any overstay you have incurred (again submitted at the embassy at the interview, certainly not before).

Your case is not for a layperson, it sounds like you are dealing with tricky bits of immigration law (focusing on the asylum case, appeals, visa extentions etc). I suggest you retain the assistance of a thorough, competent immigration lawyer for your journey.

Well, no we can't tell you exactly when it will be sent because we don't know. The VJ timeline is just an indicator, that is why it says it MAY be adjudacated. I certainly hope it is but for sure, no one knows.

If you signed up for electronic updates using your case receipt number on the USCIS webpage, then you will receive an e-mail that your approval is on the way, then the USC should get the Notics of Action 2 in the mail.

Yes, he can (and should) file the petition as soon as possible. He can list his parents address as his US residence. That is an excellent idea. By the time the embassy requires documentation to be sent back, you should be back in Canada by then so it sounds like it will work out. You should list an address in Canada (like your parents) so receive any mail that might come in.

Yes, you'll need a co-sponsor. The parents are perfect for that too

Ask lots of questions but read the guides too, they are very helpful

Take it from someone who had a lawyer, the CANNOT speed up the process, they CANNOT ensure success, and they often do slow up the immigration process.

Do they reject you for work visas? Certianly! I got rejected from 2 (even with a US company sponsorship) It is becoming more common to reject work visas in this economy - this is certianly not your best option

Go for the K-1.

A work visa is volitile, if you lose your job (and in this economy...what job is safe) you generally have to leave. Then where are you? back exactly where you are now. K-1 is more stable and is on the route to a green card!
