Dublin is a pre-clearance port, so therefore you'd go through US immigration and customs in Dublin, not in the US. SO if you are denied entry, your cost would only be from Dublin to home, not from the US to home

No minimum amount of time required to have known your fiance. However, some consulates will raise flags if you file too quickly after knowing or meeting.

A lot of weight is put on meeting in person, as in you MUST meet in person before you petition for your fiance. If you do not, your petition will be rejected (as you must show proof of having met in person) and they keep the filing fee

he may visit, admittance and duration of stay is up to the border agent at the time of crossing.

Look at 8 - 12 months for a total from petitioning to visa

Each petition that is submitted to USCIS is given a bar code. The bar is scanned everytime the petition is handled. For example, if a petition is received and passed on to someone else to file, the bar code is scanned. This helps track the petition and lets the adjudicators know where each petition is and who handled it last

So a 'touch' is your 'last updated' date on the USCIS website. A 'touch' could mean your petition was moved, counted, placed on an adjudicators desk, or moved from filing cabinet A to cabinet B due to a leaky pipe

There are a few ways in which you can make sure that the petition stays at the Consulate.
1) Get in touch with the Consulate asap: Email them, phone them and explain your situation.
Note: While emailing the consulate, make sure you include your case number in the Subject line.
2) Get in touch with your Congressman/Senator. With elections around the corner, I am sure they will look in your case with more zest.

As crazy as it might sound, sometimes its not too fun being the last interview of the day. I have read tons of posts on here and the thing is, if they suspect a fraudulent relationship, they might save you till the end of the day or they may not. It just depends on what consulate you are dealing with.
If the C.O. has already made his/her decision before the day of the interview while he/she was reviewing your file, it is very hard to change his mind.
Please ask your fiance to make a list of all the questions asked, in the order they were asked. Also, once you hear from him, try to make sure that the case stays at the Consulate and it is not drafted back to USCIS.

b) Is this a vast age difference between you and your fiance?
c) Did you have a ton of evidence pertaining to your relationship?
Also, the tourist visa denial does not play any role in a decision for K-1.

Well, if you don't have your medical records, thats a good thing because you are not supposed to have them. These medical documents will be transferred to USCIS and will be useful when you file for your AOS.
I have no idea why your kids medical records were handed back to you!

when i arrived here in seattle wa. last oct 11 i did not notice that my medical record was not returned by immigration officer at port of entry only for the kids but mine was not included passport and I-94 was returned but on the yellow envelope that was given at the US embassy Phil only kids record was returned i just only noticed awhile ago bcoz too busy and too excited to c my fiance 1st time we arrived


Well, when I crossed in to the US, the CBP officer took my envelope and that was about it. They don't give anything else back to you except your passport and I-94.
As far as your kids medical records are concerned, maybe you were advised of something specific at the time of your interview or at the POE.
Do you recall being advised about something like this?

I worked part-time, temporary, contract for a company over a period of three years that results in a very messy work history and now I'm not sure how to fill in the G-325 form for myself (I am the fiance, looking to immigrate to the US on a K1 Visa). Basically, my work involved up to a dozen short-term contract postings (one to two weeks at a time) over the span of three years (from 2005 to 2008). These postings were also at various locations so the "location of work" is a very wide range because I was moved around a lot did not have a central location.

Here's how it worked, I'd work for the company for one to two weeks then when my contract expired I'd stay unemployed for a couple of months and then go back to work when a new contract was written up where I'd go to work for them for one to two weeks then go unemployed again when the contract was up. I did this for three years, and have racked up over a dozen or so contracts and now I don't know how to declare this on the G-325.

It seems asinine to declare every single period of one or two weeks of employment and then a few months of unemployment as the list would be very long, very boring, and I can't imagine why anyone in their right mind would be interested in seeing that. Do they really care that much how I spent my days during that time? Can I possibly forgo being that specific about my employment and just make a blanket statement that states "Worked from 2005 - 2008 on numerous temporary, part-time contracts in various locations for [company name]"? Or do they really want me to dig up the dozens of locations and weeks I've worked over a period of three years for a part-time, temporary position that I basically did just to earn some pocket change during my college years? Ugh. Please say no, I have nightmares about the mountain of paperwork I'd have to find and set in order. :(

Hey No i dont think its gonna stop you from getting a visa .. Just make SURE NOT to lie in anything… so when u fill out your papers and it ask, have you ever been convicted of something u have to say yes!!!!
and they will ask you to explain what happend and all..!

Yikes!

we had to wait close to 7 months for our NOA2. We had a RFE which was Bull****, which made it that long. However, before the RFE my fiance had his congresswomen look into our case for us because we were waiting way past our time. Basically, they found our file sitting at the bottom of a pile on someone's desk A week later we got the RFE. So clearly, they can process the cases quickly, if they want to! Are you able to get a 'higher authority' to look into where your case may be? It may help. I believe we would still be waiting if we didn't get our congresswomens help.

I only ever had my passport stamped twice, and have been to see my fiance 6 times. They don't always stamp it for some reason, but it never seemed to be an issue with regards to evidence. I just made copies of all my flight info; itinararies, boarding passes, etc.

I certainly hope not! I'm about 50K in student debt after a million years of university.... Canada doesn't care where I am, as long as I pay it on time each month.
Your fiance should be fine. Keep in mind, she most likely won't qualify for any repayment assistance (eg: not making her pay interest on the balance while in repayment or something like that) unless she is still a resident of the country in which she got her loan. That's how it works in Canada, anyway.
Just make your payments on time each month, and there should be no big deal.



Random question....What would happen if you don't pay off the student loan, and move?

First time posting in the forums, long time reader now...

I'm Canadian, my fiance is American. I'm currently visiting him in America.

We filed our I-129F March 15, 2010 and received our NOA2 September 23, 2010. This past week we received a letter from the NVC indicating that they had received the approved I-129F and that the petition would be forwarded to the Montreal Consulate within a week. We have our Montreal Consulate Case Number.

The letter concludes with a paragraph stating "Your spouse will soon receive a packet with instructions from the consular section on how to apply for your K3 visa at that post and what documentation will be required..."

This threw us for a loop. K3??? We're not married. We're applying for a K1 visa in order to get married. Is it normal for them to send us this letter mentioning a K3? Who do we contact to confirm there has been no mistake? The NVC or the Consulate?

Sorry for the multiple posts here... the questions just keep cropping up!

Sent the I-129F on March 15. Entered the US on Aug 31 as a visitor (land entry, no passport stamp, despite asking for one). While I've been here my fiance received NOA2 on September 23, 2010. We're waiting for Packet 3 (to be sent to my Canadian address, where my parents are there to receive the package).

I intend to return home by November 21 at the latest, and would like to return to the US to visit my fiance for the month of December. I know that I'll need lots of proof of ties in Canada in order to hope to get in.

I'm a retired professional and am a self employed photographer, making a letter from my employer rather impossible (though I intend to show my booking calendar with proof of work back home). I have sufficient funds in my bank account and statements to show that. I can book myself a return ticket to show intent to return.

Should I anticipate trouble at the border trying to come into the US? What else can I do to show ties to home, and an intent to follow the law?

Seems to be something about a change of address. You notified them that you didn't get a notice. Have you checked with them that the address they have is correct in their system?

Montreal is the only interview place for CR1 IR1 and for K1

Vancouver only does K1.

If you want to get married and dont want to wait for K-1 to marry in america. Do a CR1, you can marry anywhere and then do the CR1 petition for your wife.

K-1 you have to marry in america no choice, its part of the rules for the visa, and you cant get married untill you get the visa and enter america. like the other person said, if you marry before you get the visa then your petition for a fiance(e) is void because you are married.

RFE is a request for evidence. They need more papers.

Intent to deny is intent to DENY. Which means they intend to deny you/ not allow you to proceed and your petition is denyed.

Need some more information on the notice you got to really say what is doing on. What does the notice say and where are you in the proceess of your filling?

I never got any letter with my case number on it, never got any paper from NVC at all, I called DOS and asked them and got my case number and was told it had already left NVC and only stayed there for 2 days. If you try calling DOS you might get a better answer than NVC.

when you get your ssn it will have big black letters across it saying not allowed to work. after you get your green card or ead card you go to the ssn office and request a new card without the words on it as you will be allowed to work then.

She would check it if she has not gotten her EAD or her green card as shes NOT allowed to work but is allowed to have an ssn card/number.

When i filed mine I had NOT filed yet for aos. I checked that box and they requested to see my passport, my out-of-country drivers license and my marriage certificate as proof I was allowed to be issued an SSN. It took about a month to get it in the mail after that.

So i would check legal alien allowed to work even though I do not have a EAD or filled AOS yet?



No you dont have ead or green card you arent allowed to work. if you check it they will ask for your ead or green card which you wont be able to provide.
