Just an FYI - when he gets is K-1, he'll marry you and adjust status to a permanent resident. He won't be eligible for citizenship until he's been a permanent resident for 3 years

1. Your immigration status is pending K-1. You can mention that you'll apply for permenant resident status shortly after entrance on your K-1 per the terms of the visa (just in case the application judges don't know what a K1 is)

2. Yes, people on K-1 have attended school. How and the costs are up to the school you apply for. Some will consider you a non-resident, some as pending resident

have you thought of asking these questions to the school you're appling to?

3. you can leave the US anytime after you enter. However, if you'd like to re-enter the US after your wedding, you'll need your advanced parole document which can take up to 90 days to arrive. If you leave before you have your AP document or your green card, you cannot enter back on the K-1 and your AOS will be considered abandoned

Leaving the US is not the issue, you may leave at anytime. Returning to the US is the issue. The K-1 is a single entry visa - that means once you use it to enter the US, you cannot use it to enter the US again. In order to re-enter the US after you come on your K-1, you need your green card or your advanced parole document. Advanced parole is applied for when you submit your AOS documents.

Your return ticket and your letters from both employers are good, What about bills that you have pending (utility bills, cell phone bills? credit card bills)? Do you pay your parents any sort of rent? A letter from them would be good of when they expect you to return.

While visiting is not a guarentee, the more prepared you are, the better chance you'll have at admittance.

Oh, don't forget a copy of your K-1 packet

If you currently have a visa, of course you can try and visit. Admittance and duration of stay are up to the CBP at the time of crossing. There is no guarentee. Currently holding a valid tourist visa simply means you can apply for admission, it is not a guarentee of entrance.

If you do not currently have a tourist visa, you may apply for one.

You will need to provide strong ties to your home country - and if admitted, you may only stay for the allotted time

If you cancel the K-1 now, you've wasted 3 months. SO that isn't good. Plus, the K-1 goes slightly faster than the CR-1 because of the time the CR-1 takes at NVC - which the K-1 does not. HOwever, the Cr-1 does allow for work and travel upon entrance.

USCIS process at about 5 months - so if you cancel now, you'll still have to wait your processing time since K-1s and Cr-1 process at about the same time at USICS

You can get married anytime you want. However, if you get married before the K-1 is issued, you no longer qualify for the K-1 and all your fees and wait times are lost. You'd have to reapply for a spousal visa

We got married in Canada and applied for a spousal visa

Many people get married in the US and return to their home countries to carry out the spousal visa process. The USC petitions for his/her spouse. But the K-3 is a dead visa, it is now the Cr-1

You should consult an immigration attorney, if he was deported in absentia, this WILL complicate your case. You must prove that he was not deported, but voluntarily left which I have NO idea how you do

This has been done, but only for Canadians for some reason. It is totally up to the discretion of the CBP and may either make you enter with the K-1 or turn you around. BUT, if this is done once for you, it is unlikely it will be done again. Part of being granted this visa is no longer continuing to visit, but actually immigrating

First of all, tourist visas are for tourists - those who intend to visit the US and return to their home country. The intention of your fiance getting a tourist visa is unclear by your post so I thought I'd clarify that

The K-1 fiance visa is slightly faster (but more expensive) than the spousal visa. However, it requires you to marry in the US. You cannot legally marry outside of the US and often 'religious' ceremonies are mistaken for legal ones and K-1s have been denied for that reason. I'd play it safe if it was me. If you want to marry in Columbia, petition for a Cr1 spoual visa.

A lot of people want the fastest way - as did we. However, the need to work and travel was important to us as was the cheaper cost of the Cr-1

Sure, I don't see why the USC cannot start the K-1 process while abroad. All the documents will still have to be sent to the US and you'll likely have to interview in France - someone correct me if I am wrong.

Dublin is a pre-clearance port, so therefore you'd go through US immigration and customs in Dublin, not in the US. SO if you are denied entry, your cost would only be from Dublin to home, not from the US to home

Make sense?

Bring any and all ties you have to your home country, including utility bills, lease or mortgage, proof of sufficient funds in the UK and a copy of your NOAs
