Im not sure about the 1 and 2 questions but the 3 question, being pregnant doesnt really change anything about your case, the only change would be if she had the baby and has a birth certificate with your name and hers as the parents, then the baby would need to go through a process to get an american passport. But if she doesnt have the baby before you do all the K1 stuff then she comes to america and has the baby in america and it is american.

Names dates and places writen on back of the photos putem in a plastic bag just so they dont fall all over in the mailer. Paper clip or staple it to a page in the petition.

We included 25 photos, stamps from both passports, itinerarys and ticket stubs from flights. Emails, msn chats, copys of snail mail cards and envelopes, print outs from phone records which we highlighted to show the phone numbers ( even tho it said my city and province beside it. )

Thank you! For some reason, when I looked it up on Google it kept telling me our service center would be Texas when I knew for a fact that Texas would just send it to VSC or CSC. I just needed to know which one. My Googlefu is no match for yours! :lol:



lol took me a while to find it. I filed back when they had the list on the USCIS website so I used key wording to try an find it again. If you look in some of the other instruction pages for other petitions it still lists them as well.

It goes to Texas first but then gets sent VSC or CSC after.

Yes the package is sent to Texas Lockbox BUT the texas lockbox is a SORTING facility. They send your petition to CSC or VSC after and it is THEM who does your petition not texas. You want to address your letters acordingly.

USCIS hasn't changed your status, the port of entry did. And yes, that can happen. They typically do this because you have either been crossing too often for them or you are, as you said, actually intending to immigrate. Some Canadians have been given an amount of time they must wait before they can re-enter the US because they are an impending immigrant and some, like me, have been striaght out denied entry because of my impending immigrant status.

Yes, they can deny you if they think you are a threat to illegally immigrate - as in using entrance as a tourist with immigrant intent. Happened to me!

When you go for your Nexus interview, make sure you bring TONS of ties to Canada to show you won't abuse the privledge

She can leave for Canada any time she wants - she cannot, however, re-enter the US without proper documentation. Once she enters on a K-1 visa, you have to marry and submit the paperwork for her adjustment of status

The K-1 is not work authorized. It was acceptable for a while but that is no longer the case.

Look at the list of acceptable documents that must be provided in order to work. If you do not have them, you cannot work in the US

SSN's are issued IN the US, you cannot get one until you enter the US. Your SSN will also have "not vaild without DHS authorization" on it, the DHS authorization comes in the form of your EAD

You cannot work in the US without authroization. A k-1 visa is not work authorized, even with an SSN. You need to get married and file your adjustment of status and apply for your EAD

You should be able to go to your local SSN office to get an SSN, however it will likely have "not valid without DHS authorization" stamped on it, which means you need a work permit

Honestly, I'd wait for the interview date. The visa is good for 6 months after it is issued. You don't have to move right away to the US. You can have more time to plan this. Plus, what are the odds you're going to find the EXACT same body shape as the original girl for the 'stand in'?

You certainly won't be granted admittance if you don't try! You have more than a lot of people who are granted admittance.

I assume you petitioned for a K-1 visa. Know that when you enter the US on a K visa, you cannot leave and re-enter the US without your advanced parole document. This can take up to 90 days to get after entering the US, marrying, and then filing your adjustment of status

So working in Canada may not be an option, unless you are granted a leave of absence

You may petition for a spousal visa, but it will not be a K visa, it will be a Cr-1 visa. Read the comparason guide to help you make your choice

you'll have to file again. The visa is not longer usable because it is a single entry visa. When you refile, they'll take care of the K-1 currently in his passport and issue you a new one. Be prepared to anwer questions about the 2nd K1, you may also have to file a wiaver if you petition less than 2 years after the 1st petition under IMBRA.

As for visiting, he may not be allowed to enter. He clearly has immigrant intent and may raise flags that he had a K-1, returned to the UK and how wants to re-enter. To help with this, he should be STRONG ties to the UK and enter at a POE outside of the US (I hear places in Ireland have US POE's in them)

As a Canadian, you are required to have your long form birth certificate (the one listing your parents' names). You can work on getting that as it can take 6 weeks to procure.

Applying for the spousal visa, after you marry in April 2011, will not be enough time if you want him back in the US by September. Bank on 8 - 10 months for this process. Your best bet is to file the petition for a K-1 now. It will take a few months to process and when he applies and is accepted, he has 6 months to use the visa (in case it is approved BEFORE he is ready to leave)

Student fees and tuition for non-residents is VERY expensive, it will be beneficial for him to start school as a resident. Also, to obtain an F-1 student visa, he'll have to show that he intends to return to the UK after his visa expires. This may be difficult to do because, obviously, he doesn't intend on doing that.

My advice, follow the guides for a K-1 visa
