I was denied entry, I know how much it really stinks

The problem is, you'll have an exponentially more difficult time crossing now because you've been flagged as having immigrant intent and because you lied to the CO. A denail won't impact any K-1 or immigrant visa you have (unless you signed something or have something stamped in your passport...do you?)

The chances of getting denied entry again are strong, but not impossible. You'll have to show a RIDICULOUS amount of ties to Canada before you try and re-enter again (again, knowing from personal experience) because you'll be taken into secondary screening immediatly.

Oh yes, we got our RFE about 3 weeks before our NOA approval which was at the 6 month mark

Keep in mind that when you submit your petition, no one looks at it, it sits on a shelf until someone picks it up to look at it to determine if there is any missing information. No one has looked at your petition yet, so it is natural that the RFE will come after 'so long'.

She was denied entry (this is important as you will have to answer any questions pertaining to the incident on forms so might as well start using that term - no 'air quotes' necessary).

I was denied entry for a similar reason, lack of ties to Canada and presumed immigrant intent (actually, I was denied entry twice)

Denied entry simply means she was not granted entry into the US

No need to do an FOIA because if there isn't anything in her passport then she should be fine.

This won't be an issue as long as you are truthful and disclose the incident on all forms she submits in the future

The above is mostly correct. Her admittance into the US is based strictly on the CBP at the time of crossing. She should always bring ties to Panama. When applying for another tourist visa, to avoid any specualtion to the contrary - she should list you as her fiance living in the US.

If she was denied entry (which can and does happen....it happened to me) it likely won't be issued as a 'deportation' (which would heavily complicate your case). It would likely be listed as a denial of entry or at the most extreme an expedited removal.

There was a case on here a few months ago where a woman entered the US and said she was visiting her boyfriend. At her K-1 interview, the CO did some digging and found that it wasn't her 'boyfriend' she was visiting, but her fiance and her case went downhill from there

Apply for the new B-1 when you like. Just remember to be as open and honest as you can

1) if you got married while she was in the US previously, then it wouldn't be an issue likely. However, now that you have the intent to marry and adjust status - doing so would be visa fraud which can carry a lifetime ban from the US.

2) Put your american address as that is where you live. You currently do not live in Brazil, you are visiting. Do not confuse the two.

3) If you cannot prove you make 125% above the poverty line, you'll need a co-sponsor who can show that they can. No issues here, happens all the time

Good luck, file the I129F paperwork now and get rid of the adjustment of status idea

First of all, relax. I've seen hard copy NOA-1s take up to 60 days to arrive in the mail. Plus, you filed just before the holidays, which means everything will be delayed.

You have your case number, follow up in January if you still haven't received your NOA. Quite possibly they cashed your cheque (always the first thing, they do want your money) and have let the paperwork part sit until the holidays are finished.

A touch almost always follows the cashing of your cheque as they file your petition to wait adjudication.

If your fiance is facing deployment (which I'm only guessing if he is currently living in military barraks) then look into filing an expedite

Photos and pictures and e-mails are secondary evidence. You want to focus your petition on primary evidence, proof that you've met and spent significant time together - things such as bording passes, hotel receipts, etc.

Secondary evidence is helpful, but thousands of e-mails and hundreds of photos is WAY too much. pick from from the duration of your relationship and leave the rest

I'm sure it will be fine that you send your originals to the consulate, I did not to the K-1 route so you may want to post this on the canada forum for verification

You may ask that your visa be issued for pick-up, however, some of had luck with this, others have not. It is up to the CO you get on the day of the interview. Assuming all goes well (which it doesn't always) you can probably move within 10 days or so after the interview

3. It took about 7 days from my approval to get my visa. I took another 2 weeks to pack up my stuff and move. You do not have to move with your fiance, you may move down there when you are ready. Although I understand why you would want to travel with him

The Montreal consulate allowed the USC to be present at the interview but it really didn't matter. SOme consulates do not allow the USC to enter the building. Not sure about Turkey

Welcome!

The I-797C is a document sent from USCIS to indicate a Notice of Action (often called an NOA here). That notice of action could be an acknowledgement of receipt of your petition, a request for more evidence or information, a notice of intent to deny, an approval of a petition etc.

Typically a few days/weeks (hopefully) after you submit your petition, you will get your NOA1, which is the acknowlegement of receipt of your petition. If you are lucky, the next NOA will be your petition approval - typically running about 5 months after your NOA1

Yes, if you live in Ontario you will interview in Montreal. If you lived West, you'd interview in Vancouver

K-1 has a derivative visa for your children. Make sure you list them accordingly on the paperwork and adjust their statuses when you marry and file AOS for yourself.

You can visit, but like always, entrance is not a guarentee. Tell the truth. If you are visiting your fiance then say...you are visiting your fiance. Always bring strong ties to Canada to help with the crossing

You cannot move to Canada without authorization. You, as a US citizen, may travel there for up to 6 months but you cannot work. In order to live and work in Canada, you must have the appropriate permission. Do not 'move' to Canada and then try to find a job

It's always 60 days.

Keep faith, ours did not take 60 days. Afte our RFE was accpeted by USCIS, you should get an update that your case has resumed processing (if you are getting updates or tracking your case on the USCIS website). After that, it was about 2 weeks until we got our NOA-2

They will not stamp passports at the Canadian border..trust me I begged and pleaded..I needed proof that my daughter was entering the US legally when I drove to get her...they would not do it..try explaning to immmigration how she got in the US legally with absolutely no proof..was not easy.

as for the I290B I also filed one of those and it took 5 months even tho the letter they send you when they receive it says 30 days

First of all, Merry Christmas and Happy Holidays to you too!

Make sure you carry as much proof as you can with you which depicts ties to Netherlands.
1) Copy of lease or a rental agreement would be good.
2) Employee letters, which you have already arranged.
3) Bank statements, if you can.
4) Student loan documents, if you have any!
5) Car documents, or payment slips, if you have making payments.
Basically, anything which proves that you have significant ties with your country.
Apart from that, YES, please carry a copy of your entire I-129F package.
Do not divulge more details, but if they ask you specific questions, do not lie.

Also, I have no idea why were you denied entry in to the US, but the burden of proving that you do not intend to stay in the US right now, lies on you!

Start by contacting your congressman and senator, then book a consultation with a good immigration lawyer. You don't need to necissarilly hire them but maybe just buy an hour so you can pick there brain a bit and see what their next course of action would be.

Think of it this way, it's been over a year since they suggested your petition be revoked, at this point you could have already had the CR1 in hand. Thats a crappy way to think of things but its the truth. sad.gif
