You need supporting documents for the affidavit of support not the I-129F. That means all the supporting documents for the I-134.

Agree with Amy, because even when the restrictions are removed, you are still required to maintain residency for a certain amount of time, too much time out is not a good thing when trying to get US citizenship. Also CBP can take away the green card if they believe she is not maintaining the residency properly.

If she leaves after marrying and not filing AOS you will start all over again with a CR-1 from the bottom. Paying fees getting documents and having an interview.

K-1 visa is a ONE TIME USE. Not generally used to come to America then marry and leave to live somewhere else. Having permanent resident status means living in the US and maintaining the status also. Not getting the green card then moving to another country for 2 years or more. That would be abandonment of the green card.

My own American husband didn't know how far Hawaii was from California. You need to somehow explain in your letter that knowledge of US geography is really 100% irrelevant. But do try to get that across without appearing too scathing. You could also include any examples of what your fiance has learnt about US geography from his conversations with you. (Even if it is just talking about your own town. Which would surely be more important than anything else.)

Again, the same with the job. Explain in detail what your job is and instances of when you have talked to your fiance about it and show how what he said was correct.

In a way, this is YOUR chance to be interviewed and present the reality of your relationship. Don't go overboard with extraneous details, but do try to include some relevant anecdotes.

Money transfers can be used against you. They can be seen as buying a spouse. Don't use them unless they are specifically asked for. They are not primary evidence anyway. All they show is you giving your beneficiary money, it does not attest to the virtue of your relationship. Focus on Primary evidence and consistent records of contact

K-3 is dead, it was administratively closed earlier this year.

The K-1 is slightly faster than the Cr-1 spousal visa; however it is almost twice as expensive and does not allow for immediate work or travel once in the US - the CR1- does. So if working and traveling aren't important to you, then go for the quicker k_1

How would the postal service, a shipper, or US customs know anything about the immigration status of the person who is shipping the goods? Where are these shipping provisions described? If my fiancee sends me a birthday present before she arrives, is that unauthorized? So your statement, if true, still doesn't make any sense to me. Also, you say my fiancee "must only ship goods once a visa has been issued"; in our case the visa has been issued but just hasn't been used yet. Thanks. -- Stu


If you asked about a birthday present, I would have answered differently. You did not ask about a birthday present, you asked about clothes and household goods.

LilMermaid answered your question better than I did. Point is, she cannot import her goods until she arrives in the US. She cannot arrive after the goods. Trust me, I've tried. Regardless if it makes sense to you - it makes sense to customs and border protection

VJ guides are right, your fiance must only ship goods once a visa has been issued. The goods cannot cross before she does. Oh and shipping goods is not a right.

And yes, the US has the right to restrict import of good into their own country. Could you imagine if ANYONE at anytime could ship anything into the US?

You may marry in the US and return to Canada. NO issues there. You may also visit (regardless of if the petition has been filed or not) however, each entry is judged on its own, meaning you can be denied entry at any time - whether a petition has been filed or not. Bring STRONG ties to Canada to make each crossing easier.

The process will take 8 -12 months from start to finish. So file 8-12 months BEFORE you'd like to move to the US. Only after the Cr-1 visa has been issued does the statement you quoted above apply (you know..the one where you cross into the US and automatically become a permenant resident)

Because you are married it does not entitle you to live in the US. And further, using a non-immigrant visa (such as entering the US as a tourist) with the intentions of immigrating is not legal, as Jim said. if it was, there would be no use for a formal immigration system - everyone would just arrive...and stay. Cannot you not see why that would cause problems?

If you enter the US, you should have ties to Canada, a job, a lease, enrollment in school, car payments, utility bills, etc. Especially if engaged or married to a US citizen. I always err on the side of extra caution due to the fact I was denied entry into the US. If you decide to marry during that time, return to Canada to complete the immigration process

Sounds like your best bet would be to marry in the US and adjust your status from F-1 to permenant resident. That would solve your travel problems.

Your boyfriend would likly need a cosponsor - any US citizen who will claim financial responsibility for you if you become a public charge

USCIS does have customer service, but it is terribly unreliable and often cannot offer you any more information regarding your case than what is posted online, and when they do - frequently it is wrong. So feel free to call them but take their advice with a grain of salt.

NVC has better, more reliable phone service but can only be contacted with questions once you've received and NVC case number (but I guess general questions can be answered as well)

I think you might be a bit confused. She must travel to the US on the K-1 by the expiration date on the visa.

Once she uses the K-1, it is invalidated - meaning the expiration date on the visa is irrelevant since it is a one time use visa. She will be issued an I-94 with a 90 day duration (an expiration date should be given on it). you must marry by the expiration date on the I-94.

Her visa is useless and 'expired' the second she sets foot in the US. You will go by the I-94 date after she is in the US

I agree, don't give notice to your job until your visa is in hand, don't go by the timelines you've made up for yourself (IE - May departure) as SO much can happen between now and then.

My advice, give your 3 months after your visa has been issued, that way you can have additional time to work and settle your affairs in Italy

There is no guarentee that you'll be admitted to the US, even with a valid tourist visa. To make your crossing easier, bring strong ties to your home country

A denial or expedited removal (can be treated as a 'deportation') can happen. It happened to me, I was not allowed to enter the US. It was not considered a deportation but I had to disclose it on the appropriate forms and I was fine

G-325A for Petitioner and/or Beneficiary is not Signed and/or Photos not Submitted.

Purpose: To provide field offices with guidance on processing Form I-129F petitions when the accompanying G-325A is missing signatures and/or photographs.

A properly executed Form G-325A is required for all I-129F petitions. Previously it was standard practice to issue an RFE when the beneficiary failed to sign the G-325A and/or failed to submit photographs. From the date of this memorandum, an RFE should not be issued in instances where the beneficiary failed to sign the G-325A and/or failed to include photographs provided that the beneficiary is residing abroad. The beneficiary will be required to sign the Form G-325A and/or submit photographs at the time of visa issuance abroad. It is also not necessary to RFE for the petitioner’s signature on the G-325A, if the petitioner failed to sign it. The signature of the petitioner on the Form I-129F should be deemed sufficient for purposes of adjudicating the petition. Finally, it is important to note that the petitioner’s photograph is still required for the adjudication of the I-129F, so if it is missing, it must be requested prior to adjudication.

G-325A needs to have original signatures, so if you scan it to her (or she can download it off the internet herself) and then sends it back to you, that would be fine

I agree with Penguin, just because her tourist visa expired in 2009, does not mean she had permission to remain in the US until 2009. It is exceptionally rare for a person to be granted admittance into the US for longer than 6 months on a B-2 visa(and those who are, are generally for humanitarian or medical reasons - not simply to attend high school) How long was she in the US continuously? Did she enter at 15 then leave when she was 26? Did she leave the US every 6 months?
