Although you are living and working in Canada, you still need to file US taxes

Read my post again, I said you cannot live in Canada WITHOUT AUTHORIZATION. meaning do not overstay.

K-1 seems to be your way, Vancouver and Montreal only do K visas, if you were looking at a spousal visa, Montreal is the only consulate that does spousal visas

Also, my post said 90 days AFTER you marry and file your AOS. It could be longer than 90 days for you to get your work authorization after you enter the US.

You will STILL have a domicile issue. I suspect separation is in your future, the sooner you accept that the sooner you'll be willing to accept this process

Being from Canada does not impact your process any. Look at 8-12 months from start to finish for this process. It took ours 10 months!

If your looking for work ASAP you're looking at a spousal visa. K-1 requires the beneficiary to marry and file AOS and apply for the EAD before work is available. This can take up to 90 days after entering the US.

You CANNOT stay in Canana without authorization. However, you could marry now and file for a spousal visa directly with the consulate. This is your quickest way and allows your (current) fiancee to work as soon as she enters the US.

However, Montreal is VERY VERY VERY strict about domicile in the US - this means the US citizen must prove they have moved to the US already. Generally this requires the USC to have a home and a job in the US before the beneficiary can immigrate. They are, again, VERY stict about this. Without successfully proving domicile, your fiancee will not be able to immigrate. Because of this, it is unlikly that ZERO separation will be had

You have a lot of reading to do. You can only file DCF (directly with the consulate) if you are legally living in Canada (as in not as a tourist).

Further...cheapest? The K-1 is almost $1000 more expensive than the spousal visa

A marriage will not erase the reasons for the denial. If the K-1 is denied, the issues must still be addressed

However, if the K-1 is denied and the petition cancelled, one may marry and file for a cr-1 visa ( no more K-3 ). Again, must combat the reason for denial.

Don't make any wedding plans, and certainly no deposits, until the visa is in hand. SO much can go wrong before the wedding date which can lead to multiple delays.

And if you ignore the above advice, I don't think the probability of your fiance being in the US by October is high. IN fact, I think it is low

Oh good! Thank you! I thought it seemed kind of silly to have a 4 month window to get everything done, especially out of Montreal! They are so busy there by the looks of it.

My NOA2 says it is valid from Jan 3 2011 to May 3 2011. I just received package 3 on Friday. When setting up my account online for DHL, it said the next available date for an interview at the Montreal consulate is May 20th.

Now, does that mean I have to refile or is that the time given for me to book my interview?

I can't book my interview until I get package 4 from what I understand. I am pretty sure the date will be pushed further back by then.

Hey everyone,
New visa journey member here from Canada :) My fiance & I just got engaged and just sent our I-129f package in mid January. The sample forms here REALLY helped when we were compiling the package :)

My fiance just received this in the mail (attached image)..it says I-797C, but is this also the NOA 1? If not, what would the NOA 1 normally look like? I checked the forms in the 'Gallery' section but not sure if ours is NOA 1...?

He told me it was a misdemeanor and he was never convicted, just arrested. It says convicted on the form, not arrested.

My fiance does have a case that was about 12 years ago, the charge was brought down to a smaller charge and then exponged. However I am unsure wether to include this or not in the paperwork, should I include it anways? We had trouble even gaining entry into Canada...because it came up as a felony even though that should have been removed years ago from the database ( so we were told). HELP!

I just thought of something thats really silly...

When I fill in the fiance letters of intent do I Keep "Fiance letter of intent" on the top of the letter, (as in the sample forms) and same with the I-129F Cover letter?

And what address do I use on those? I'm filing through Texas, and heard they all go to texas now to speed things up. Do I use the Texas address on all of them? And then they forward it to the appropriate place?

They put her on hold and request all missing documents and you can sit an wait for weeks after they get them for the visa to be issued! which would be sucky to happen. Some people have waited 4+ weeks after they handed in evidence requests to get their visa. I wouldn't recomend not having it.. delay the visa and her getting there to be with you.

The montreal embassy is really small, theres not alot of room. When I was there ALL the seats were full and even some people were standing.. They prefer the beneficiary go alone, But someone was there for their CR-1 interview with their husband with them. He pretty much just sat in the waiting room the whole time tho..

Syrian embassy maybe? contacting the syrian government or a police station there. Not quite sure if they have a Syrian embassy but if they do they should be able to help, you could call and ask them. Maybe find the number on google. Not really sure how else tho just going off the top of my head really.

When you send it. They take it apart and redo the whole thing the way they want it in a totally different folder with special hole punch and clips

do not pay all kinds of cash to get it bound up and everything. Waste of money and time. Just use a big paper clip and a cover letter listing the contents in order.

You have to provide divorce documentation. Yes she has to know they will likely ask her at the interview about previous marriages and if she knows about them. I was asked at my interview if i knew my husband was previously married i had to provide the divorce documents to the interviewer in person and had to answer questions about it.

Generally the lost passport is canceled when you report it missing and replace it... because a lost passport can be used by someone else so they mark it lost and cancel it so it cant be used and if tried to be used would be taken and destroyed etc etc etc.

Yes they do FBI checks, they do name checks on you and the beneficiary they do background checks as well on both of you. The checks can take a few weeks to months and some people have been stuck in checks for a VERY long time.
