Not all countrys use the US size passport photos. Generally when getting them done in another country you have to be specific as to the size you need or they will use the generic size that their country follows.

You both need to fill out an I-134, even tho you don't meet the requirement you still need to file it because its your petition for your SO.

It needs to be brought to the K-1 interview by the beneficiary unfortunately. We were really nervous about financial information too and personal info but it was worth the risk in the end really. I would send it with tracking if you can, we did that and we felt better being able to know where it is and also the ability for the post to track it down if something went wrong.

You need a co-sponsor, you need to make 18,212$ USD a year. The USC is the one sponsoring the Beneficiary.

The loan wont help with the income requirements, it does not count it is not income and it just appears in your account. If it will help you pay for things you guys need before your SO can get a job then you may want to get a loan.

The K-1 interview is generally optional for the USC. (depending on some countrys its better to have the USC at the interview)

The AOS interview however The USC and the beneficiary must both attend.

Airlines and doctors generally do not advise pregnant women who are at 7 months to fly. It can induce early labor in air. She should have a complete medical exam to find out if she would be an ok candidate to fly at that stage of pregnancy.

If she has the baby in her country, all you need is to file a CRBA and get a US passport for the baby(as long as the baby is yours and you are a USC). It would also be a lot less expensive than having the baby in the US with no medical insurance. The K-1 is valid for 6 months at the time of issuance so there would be time to do the CRBA and get the US passport for the baby and have her enter the US with the baby.

Thanks everyone you have all been very helpful much appreciated, i did speak to my GP nurse and she stated that i only need MMR once in my life and i had this in 1994 but i thought it only last 10 years.


You do get MMR boosters usually at 10 year mark. Some may not need it if their body keeps a good hold from the first injection, if you are unsure about getting one ( its safer to know you have it if your going to have a baby )you can have a titre test done by your doctor to check the MMR immunity levels in your body, if they are still high then you shouldn't need a booster really.

ahh i see..I read somewhere about primary/secondary evidence but I wasn't sure where to look on VJ for a list of which one is which. I guess for now we'll let them decide on what they have. There are some days I feel confident and there are some days I want to send them DNA samples of evidence that we have met..it's just so difficult to know what to do at this stage apart from waiting to see what happens.


I felt the same way too when we were waiting for K-1, bouts of nervousness and a few freak out moments over thinking "did I forget to sign something?"
You will get through it just keep holding on! Have him see what the liaison can do for you guys, i'm sure you will hear something soon.

I hope you're right. Well, he has to send them some paperwork to update some stuff on the file, would it help if we sent some photos we took in dublin? We look more like a couple than soldiers standing at attention in the dublin photos.

I would bring thos photos to the interview and see if they want them/give them to the interviewer instead of trying to send them without an RFE for photos. They usually look at photos as secondary evidence anyways. The passport stamps and stuff are more what they want to see/proof that one of you had actually traveled and the pictures are just a helper.

Now, you cannot appeal unless you can prove you met within 2 years BEFORE filing. You cannot visit, then appeal. Do you have any proof that you met within 2 years of petioning?

how old is your son? If he is less than a year old, well that is good enough if you ask me and you can appeal.

Perhap get your K-1, marry in the US, file AOS and AP, receive AP, travel back to your country, marry again - that would work

What visa do you want to apply for? A spousal visa or a fiance visa?


If you visit him in the US and marry, you are actually expected to return home. So no issues there, you do not have to be in the US while he petitions. He would then have to petition for a spousal visa

If you apply for a K-1, you enter, marry and must stay in the US until you get your green card or travel document before you can leave

Do NOT make any plans in India. Your 6 month time frame, while possible, is not the norm.

She can leave the US at any time after she enters on her K-1. She CANNOT re-enter the US without her physical green card in her hand or her advanced parole document. If she leaves without these documents, she will automatically cancel and AOS paperwork you have filed. It can take up to 90 days to receive this AP document after AOS has been filed

Some have been able to cross into the US as a visitor after the K-1 was issued. It is soley up to the CBP when you try and cross. MANY have tried, but only a handful were successful. You can try, but there is no guarentee that you'll be admitted as a tourist with a valid K-1

Welcome to VJ

As the others have said, 5 months to get your NOA2. You want to look at 8 - 10 months from start to finish. where do you live? If you are Ontario -> east, the interview will be in Montreal and although they are getting better, they are backed up and some have waited 5 months just for an interview. Manitora -> west will interview in Vancouver which is subtantially quicker.

Do not set unrealistic timelines. Touches don't mean anything so if you never get one or if you get 30 - it doesn't matter.

We all want(ed) this journey to end quickly. However, there is a process to go through and if you keep your head up and be realistic and come to VJ for advice and support, then you're well on your way.

You can start by getting your long form birth certificate, the one with both parents names on it. This will be needed so don't wait as some provinces can take 8-10 weeks to have your delivered

This would be considered secondary evidence. They are looking for primary evidence that you have met in the past 2 years, such as bording passes, travel receipts, visa stamps in the passport

You can submit these but do not think that these alone (without primary evidence) would satisfy USCIS

You have a few choices. You can file the K-1 fiance visa which will save you some time because you can file today. OR you can file the spousal visa after you marry. However, you'll have to return home if you marry this summer

If you marry in Japan, you could file for his spousal visa (cr-1 not the K3) directly witht he consulate and decrease the amount of apart time and the wait time

No - if he enters on a K-1 he would not be able to work right away, on a spousal visa he could.

If you are married in Japan, you are married in the US. You cannot get married again.

The spousal visa is about $1000 cheaper than the fiance visa because you do not have to adjust status. If you file with the US consulate in Japan it is quicker

Can she defer her acceptance? She may receive cheaper tuition as a non-international student.

Plus, planning on entering on a non-immigrant visa such as an F1 with full intentions of immigrating is visa fraud. I'd stay away from this if possible

Check with the school, may programs offer deferred enrollment

Although you are living and working in Canada, you still need to file US taxes

Read my post again, I said you cannot live in Canada WITHOUT AUTHORIZATION. meaning do not overstay.

K-1 seems to be your way, Vancouver and Montreal only do K visas, if you were looking at a spousal visa, Montreal is the only consulate that does spousal visas

Also, my post said 90 days AFTER you marry and file your AOS. It could be longer than 90 days for you to get your work authorization after you enter the US.

You will STILL have a domicile issue. I suspect separation is in your future, the sooner you accept that the sooner you'll be willing to accept this process
